Indiana Medicaid: War on Families: FSSA Freezes Care
INDIANA'S WAR ON FAMILIES: THE WAIVER FREEZE CRISIS
They promised you help. They promised you choice. Now, the state is slamming the door in your face. A crisis is exploding across Indiana, and it’s hitting our most vulnerable families. The Indiana Family and Social Services Administration (FSSA) has declared war on your right to choose care, trapping disabled Hoosiers in a nightmare of neglect and bureaucracy.
FSSA has frozen all new provider certifications for Home and Community-Based Services (HCBS) waivers. This isn’t just red tape; it's a chokehold. It means if your current provider isn't working, you’re stuck. If you find a new, better caregiver, they can't get certified to help you. Your choice has been stolen, fueling a catastrophic caregiver shortage and leaving families desperate.
THE SYSTEM IS DESIGNED TO BREAK YOU
They’ve put a stopwatch on your love. Family members—spouses, parents—are now shackled by a strict 40-hour per week cap on paid caregiving. Does your loved one’s disability clock out after 40 hours? Of course not. It's a cruel, insulting limit that forces families to burn out or go broke.
For parents of children with extreme medical needs, the fight is even worse. The state makes you beg for an "extraordinary care" exception, burying you in paperwork and impossible standards, all while your child’s health hangs in the balance.
And when it’s time to renew your child’s plan—the PCISP—prepare for battle. Hours are being lost in bureaucratic black holes. Case managers are changing, paperwork is vanishing, and authorizations are being delayed for months. Every delay is a threat, risking lost services and pushing families toward the one place they never want to go: an institution.
YOUR BATTLE PLAN: HOW TO FIGHT BACK NOW
You are not powerless. It's time to fight. Here is your plan of attack:
- DEMAND A STATE REVIEW: If your child needs more than 40 hours of parental care, formally request a state-level review for "extraordinary care." Get it in writing.
- TRACK YOUR PLAN: Stay on your case manager. Demand weekly updates on your PCISP submission and authorization status. Do not let them forget you.
- DOCUMENT EVERYTHING: Keep a detailed log of every missed shift, every care gap, and every minute of service you lose because of these delays. This is your evidence.
- FILE A FORMAL COMPLAINT: If you are losing services, immediately file a complaint with the Bureau of Developmental Disabilities Services (BDS). Create a paper trail they cannot ignore.
- REQUEST A FAIR HEARING: If your hours are cut or services are denied, you have the right to appeal. Immediately request a Fair Hearing to fight the decision.
